Lama Sparsha Foundation – Sparsha Yatayat Community Platform

1. Introduction & Acceptance

Welcome to Sparsha Yatayat, a community platform operated by Lama Sparsha Foundation (“Foundation,” “we,” “our,” or “us”).

By accessing, registering, or using the Sparsha Yatayat mobile application, website, or services (“Platform”), you agree to be legally bound by these Terms of Service (“Terms”).

If you do not agree, do not use the Platform.

2. Nature of the Platform (Very Important)

Sparsha Yatayat is a community-support coordination platform only.

• We are NOT a transportation provider

• We are NOT a taxi, rideshare, or ride-hailing company

• We are NOT an employer of drivers

• We do NOT provide transportation services

The Platform exists solely to help community members voluntarily connect for non-commercial ride assistance.

3. Community Service – Not Commercial

All users acknowledge and agree:

• Participation is voluntary

• Drivers act as independent community volunteers

• Passengers are community members, not customers

• No wages, salaries, or profits are provided

• Any exchange is limited strictly to gas and mileage reimbursement

This Platform operates for community service purposes only, not for profit.

4. User Eligibility

To use the Platform, you must:

• Be at least 18 years old

• Provide accurate and truthful information

• Agree to follow all applicable laws and community rules

Drivers must additionally:

• Hold a valid driver’s license

• Maintain legally required auto insurance

• Operate a safe and roadworthy vehicle

5. Independent User Responsibility

All users understand and agree:

• The Foundation does not supervise, control, or manage rides

• The Foundation does not verify driving skill or behavior

• Users are solely responsible for their own actions

• Any agreement or interaction is strictly between users

6. Assumption of Risk

You knowingly and voluntarily assume all risks related to use of the Platform, including but not limited to:

• Traffic accidents

• Injuries or death

• Property damage

• Delays or cancellations

• Conduct of other users

Participation is entirely at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, Lama Sparsha Foundation shall not be liable for:

• Accidents or incidents

• Personal injury or death

• Vehicle or property damage

• Financial or emotional loss

• Disputes between users

• Any indirect, incidental, or consequential damages

This applies even if the Foundation was advised of the possibility of such damages.

8. Release & Waiver of Claims

By using the Platform, you fully release, waive, and discharge Lama Sparsha Foundation, its founders, officers, directors, volunteers, and affiliates from any and all claims, demands, or legal actions arising from:

• Use of the Platform

• Participation in any ride

• Interaction with other users

This release applies to known and unknown claims, to the fullest extent allowed by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Lama Sparsha Foundation from any claims, damages, losses, liabilities, or legal expenses arising from:

• Your use of the Platform

• Your conduct or negligence

• Violation of these Terms

• Violation of any law or third-party rights

10. No Insurance Provided

The Foundation does not provide insurance coverage for drivers or passengers.

Drivers rely solely on their own insurance policies.

11. No Guarantees

The Platform is provided “AS IS” and “AS AVAILABLE.”

We make no guarantees regarding:

• Availability of rides

• Driver or passenger behavior

• Safety or timeliness

• Accuracy of information

12. Account Suspension or Termination

Lama Sparsha Foundation reserves the right to:

• Suspend or terminate any account

• Remove access without notice

• Act in the interest of safety or community trust

• Do so without obligation to provide explanation

13. Dispute Resolution & Arbitration

• Users agree to resolve disputes informally first

• Unresolved disputes shall be settled by binding arbitration

• No class actions or group claims are permitted

• Each party bears its own legal costs

14. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles.

15. Changes to Terms

We may update these Terms at any time.

Continued use of the Platform after updates constitutes acceptance.

• You understand this is not a transportation service
